Terms of Service

Agreement and eligibility

These Terms form an agreement between American Business Capital Group, Inc. and the person or organization accepting them. You must be at least 18, have authority to bind the customer, and use SalesPitch AI for lawful business purposes. An order form or enterprise agreement signed by American Business Capital Group, Inc. may supplement these Terms and controls if it expressly identifies a conflict.

Accounts and customer responsibility

You must provide accurate account information, protect credentials, restrict access to authorized users, and promptly report suspected misuse. You are responsible for workspace activity, products, offers, prospect selections, scripts, campaign settings, integrations, and instructions submitted through your account. SalesPitch AI may pause actions when membership, policy, identity, provider, or safety evidence cannot be verified.

Subscriptions and billing

Pricing schedule updated September 8, 2026. Starting September 8, 2026, new SalesPitch AI Private Beta Stripe subscriptions cost exactly $150 USD per month or $1,800 USD per year. Existing Stripe subscribers who accepted the prior $75 monthly or $900 annual rate retain that originally accepted rate for the remainder of the first 18 consecutive months while their subscription remains continuously active and in good standing. The annual rate is 12 times the monthly rate; it is an annual billing option, not an additional annual-prepayment discount. The selected cadence renews automatically until canceled and has no trial, setup fee, automatic overage, or separately included provider charge unless checkout expressly says otherwise. Plan price, cadence, included entitlements, and material limits are shown before checkout. You authorize Stripe to charge the selected payment method for recurring fees and applicable taxes. Except where law, an order form, or a published refund commitment requires otherwise, fees are non-refundable and unused entitlements do not roll over.

The rate accepted at checkout is protected for the first 18 consecutive months while that subscription remains continuously active and in good standing. A canceled subscription that is later restarted uses the price then available at checkout. Monthly and annual Private Beta subscriptions grant the same plan capabilities and limits; only billing cadence differs. Active subscribers receive early access to eligible new Private Beta features and releases when those capabilities become verified and available for the cohort. Future production rates shown on the Release Schedule are not purchase offers until their enrollment periods begin and checkout enables them.

Plan changes, overages, usage-based charges, carrier usage, licensed data, third-party charges, and add-ons apply only after they are shown and authorized. A failed or reversed payment may suspend paid capabilities without removing safety controls or suppression records.

Private Beta company and lead use

Private Beta members may search, rank, retain, and use authorized company and lead records inside protected SalesPitch AI workflows. CSV, Excel, JSON, PDF, bulk download, bulk copy, and unrestricted company or lead API extraction are unavailable before October 1, 2026. Availability on or after October 1 is not automatic and remains subject to the capabilities released for the applicable plan, source and provider licenses, law, account standing, and technical controls.

These controls cannot prevent every screenshot or manual transcription. Customers must not evade technical, contractual, rate-limit, audit, or source-license protections. Applicable privacy and portability rights for the customer’s own account, billing, consent, and customer-owned workspace data remain available through the protected request process; that process does not grant bulk extraction of third-party company or lead records.

Private Beta self-test calling

An active monthly or annual Private Beta subscription may place no more than five verified self-test calls per UTC calendar day, only to no more than five U.S. phone numbers the customer owns and verifies through Twilio. Only one call may be active at a time. Each call requires a new one-time consent, current verification and phone evidence, an approved product and script, local calling hours, suppression clearance, and current provider readiness. These self-tests do not authorize cold calls or calls to unrelated businesses during the Private Beta self-test period.

Cancellation

You may cancel an eligible recurring plan through the Stripe-hosted billing portal when enabled or by contacting American Business Capital Group, Inc.. Cancellation generally stops renewal and preserves paid access through the current billing period unless law or a written agreement requires another result. Cancellation does not recall messages, calls, provider work, or calendar actions already submitted, and does not erase records that must be retained for billing, security, suppression, legal holds, or compliance.

Service access and intellectual property

Subject to payment and compliance, American Business Capital Group, Inc. grants the customer a limited, non-exclusive, non-transferable, revocable right to use SalesPitch AI during the plan term. American Business Capital Group, Inc. and its licensors retain the platform, C.O.L.T.E.N. AI™, software, designs, documentation, models, workflows, trademarks, and improvements. You may not copy, reverse engineer, resell, evade access controls, or use the service to build a competing model or database except where a non-waivable law permits it.

Customer data

You retain rights in customer data and grant American Business Capital Group, Inc. a limited right to host, process, transmit, and display it only to provide, secure, support, and comply with the service. You represent that you have authority and required notices or permissions for submitted data and intended channels. SalesPitch AI does not train shared models on customer workspace data without express authorization. The Privacy Notice describes our handling practices.

AI-assisted output and human review

AI-assisted output can be incomplete, inaccurate, or unsuitable. You must review product facts, pitches, scripts, lead criteria, compliance assumptions, meeting details, and follow-up content before approving real use. C.O.L.T.E.N. AI™ must not invent guarantees, authority, availability, appointments, or provider outcomes. Recommendations and scores are decision support and do not replace professional, legal, financial, medical, or compliance advice.

Calling, messaging, and meetings

You may initiate outreach only when the people, purpose, timing, disclosures, caller identification, recording practices, and channels are lawful and authorized. You must honor Do Not Call, opt-out, unsubscribe, suppression, and quiet-hour requirements and must not circumvent platform locks. A prepared call, hold, or follow-up is not a completed provider action. Separate provider evidence is required for delivery or booking.

Acceptable use

You must comply with the Acceptable Use & Outreach Policy. Prohibited uses include unlawfully sourced data, deception, harassment, discriminatory targeting, credential abuse, malware, rights violations, or activity that exposes American Business Capital Group, Inc., a provider, or another person to unreasonable legal or security risk.

Third-party services

SalesPitch AI may interoperate with separately governed services such as Stripe, OpenAI, telephony, calendar, email, hosting, and licensed-data providers. Their availability and terms are outside American Business Capital Group, Inc.’s control. Connecting a provider authorizes the minimum exchange needed for the selected workflow. American Business Capital Group, Inc. is not responsible for a third party’s independent service, suspension, pricing, or data practices.

Changes, availability, and beta features

Controlled-beta features may change, remain human-gated, or be unavailable while credentials, licenses, testing, compliance, or monitoring gates remain incomplete. Early access means eligible new features and releases are offered to the Private Beta cohort when verified and available; it does not guarantee that every planned, third-party, add-on, or unsafe feature will be released. American Business Capital Group, Inc. may improve or discontinue a feature and will use reasonable efforts to give notice of a material reduction to a paid service. The public Release & Trust Center is evidence of current product state, not a warranty of uninterrupted availability.

No guaranteed outcomes and warranty disclaimer

SalesPitch AI does not guarantee data accuracy, replies, interest, qualification, meetings, attendance, conversion, revenue, savings, financing, or any other business result. To the fullest extent permitted by law, the service is provided “as is” and “as available,” and American Business Capital Group, Inc. disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Limitation of liability

To the fullest extent permitted by law, American Business Capital Group, Inc. and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, goodwill, or opportunities. Subject to non-waivable law, aggregate liability arising from the service will not exceed fees paid by the customer for SalesPitch AI during the 12 months before the event giving rise to the claim.

Indemnity

You will defend and indemnify American Business Capital Group, Inc. and its affiliates from third-party claims arising from customer data, products or offers, instructions, campaigns, outreach, illegal use, or breach of these Terms, except to the extent caused by American Business Capital Group, Inc.’s own unlawful conduct. American Business Capital Group, Inc. will provide reasonable notice and cooperation, and no settlement may impose an admission or obligation on American Business Capital Group, Inc. without consent.

Suspension and termination

American Business Capital Group, Inc. may restrict or suspend access to protect people, systems, providers, or legal obligations; address nonpayment or breach; or investigate abuse. Either party may terminate as provided by the applicable plan or written order. Provisions concerning payment, ownership, confidentiality, disclaimers, liability, indemnity, dispute handling, suppression, and legally required records survive as applicable.

Governing law and disputes

Unless a written enterprise agreement or non-waivable consumer law states otherwise, Florida law governs without regard to conflict-of-law rules, and state or federal courts located in Orange County, Florida have exclusive jurisdiction. Before filing, each party should give written notice and attempt in good faith to resolve the dispute for 30 days.

Changes and contact
